Draft 18 U.S.C. § 2257 Recordkeeping Statement

1. Scope of This Draft
ScriptLAB hosts user-submitted content. Whether the platform or an individual uploader is a producer under applicable law depends on the actual production, publication, and management practices. The operator must confirm the applicable scope with qualified U.S. counsel.
2. Uploader Responsibilities
Uploaders must confirm that every depicted person was an adult when the content was produced and that they hold required identity and age records, valid consent, and distribution rights. Content depicting, or reasonably suspected to depict, a minor is prohibited.
3. Recordkeeping
If the operator is a producer subject to recordkeeping duties, required identity and age records must be maintained in the prescribed form and for the required period. The name, physical address, and inspection hours of the designated records custodian must also be disclosed.
4. Operator Review Required
This draft does not yet identify a records custodian or address. Before launch, the operator must appoint the responsible person and obtain legal review of the service's obligations and notice language under 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75.
5. Reporting Concerns
Report suspected age-record or consent problems through support with the content URL and reason for concern. Urgent danger or suspected child sexual abuse material should also be reported immediately to the appropriate authorities.
